In a continuing effort to strengthen the city of Apache Junction by helping increase property values and becoming a more attractive place for business, the city has adjusted some property maintenance standards under Chapter 9 of the city code.

The revisions follow a consistent effort by the city to focus on improving the beauty of the city, enhancing property values and addressing health concerns in the community. In 2017, the city council directed staff to update the code accordingly and held public discussions on Nov. 5, 2018, and Dec. 4, 2018. The code had not been updated since 2006. The city also used state law as a guide in revising the code.

“This will improve the city’s attractiveness, raising our profile with potential residents and businesses,” said Mayor Jeff Serdy. “We have spent significant time and money across the city on sidewalks, street lighting, streetscapes and parks and know what a great place this is.”

Under changes unanimously approved by the city council on Dec. 4, 2018, and going into effect on April 1, 2019, here are some key revisions:

  • Requiring that the exterior property and premises be maintained in a clean, safe and sanitary condition, keeping the exterior free of the accumulation of debris, trash or vehicles that cannot be profitably restored or salvaged for parts.

  • Ensuring garbage be stored in approved receptacles and should not be stored for more than 24 hours outside such a receptacle or enclosed building.

  • Codifying that no inoperable vehicle shall be parked on any premises unless it is provided for in other regulations. Minor vehicle repairs continue to be acceptable, unless prohibited by home owner association rules or the management of a multifamily property.

  • Major vehicle repairs should be conducted in a garage or approved structure and only one vehicle may be under repair at a time. Repairs shouldn’t take more than 10 days, unless performed in a garage or approved structure.

  • Common areas, such as sidewalks, stairs, driveways, parking spaces and the like, shall be kept in a proper state of operation. Buildings, structures, fences and walls also shall be maintained in a structurally sound condition.

  • An expected compliance deadline of at least 10 calendar days from the date of notice with the city having discretion to extend the deadline if deemed necessary. The first violation carries a fine of $350, a second citation at $600, a third at $1,000 and a class 1 misdemeanor if they occur within a two-year period.
